Short Terms and Conditions for Agro Nursery West Bengal
By placing an order with Agro Nursery West Bengal, you agree to these terms:
- Product Nature & Availability:
Our products are live plants (fruit trees), subject to natural variations, seasonal availability, and potential mortality. We strive for accuracy in descriptions, but actual plants may vary. We reserve the right to substitute or refund if a specific tree is unavailable.
- Pricing & Payments:
All prices are in INR and are final as displayed at checkout, including applicable taxes. Orders are confirmed only upon successful payment.
- Order & Cancellation:
You can cancel an order within 24 hours if it hasn’t been dispatched. Once prepared for dispatch or shipped, cancellations may not be possible, or may incur charges. We may cancel orders due to unavailability or unforeseen issues, providing a full refund.
- Shipping & Delivery (All India):
We deliver across India via third-party couriers. Estimated delivery is 5-15 business days from dispatch (typically 2-5 business days from order). Shipping charges apply. You are responsible for providing an accurate address and being available for delivery. Inspect packages immediately upon arrival.
- Damaged/Dead on Arrival (DOA):
If a tree arrives significantly damaged or dead, you must notify us within 48 hours of delivery with clear photographic And videos evidence. Upon verification, we will offer a replacement, store credit, or refund at our discretion. We are not responsible for the health or survival of the tree after successful delivery, as its growth depends on your care and local conditions.
- No Growth Guarantee:
Due to varying environmental factors beyond our control, we do not offer a guarantee on the long-term growth or survival of the trees after they have been successfully delivered and accepted
- Limitation of Liability:
Our liability is limited to the amount paid for the specific product. We are not liable for any indirect or consequential damages.
- Governing Law & Jurisdiction:
These terms are governed by Indian law. Any disputes will be subject to the exclusive jurisdiction of courts in Kolkata, West Bengal.
